This Agreement may be terminated by either party without notice at any time for any reason. The provisions of paragraphs 1 (Copyright, Licenses and Idea Submissions), 2 (Use of the Service), 3 (Indemnification), 4 (Third Party Rights) and 6 (Miscellaneous) shall survive any termination of this Agreement.

6.Miscellaneous.

This Agreement shall all be governed and construed in accordance with the laws of The United States of America applicable to agreements made and to be performed in The United States of America. You agree that any legal action or proceeding between Mind Lamp and you for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in The United States of America . Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. Mind Lamp's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Mind Lamp may assign its rights and duties under this Agreement to any party at any time without notice to you.

Instructions:
1) Securely repack your Mind Lamp(s).
2) Insure the package for the full retail price per lamp.
3) Send the lamp to Psyleron within 30 days of the date of purchase. See below for shipping information.

Returns and Repairs
If your Mind Lamp(s) arrives broken or becomes defective within 30 days, you can chose a repair, a replacement, or a refund. Regardless of your choice, you must mail the full lamp back to Psyleron, even if it is broken. Include a note indicating whether you want a repair, replacement, or refund, or send an email to sales@mind-lamp.com and let us know what you want. Note: Psyleron will only refund the amount you paid for the lamp—we do not refund shipping. If you request a repair or replacement, you must pay to ship the lamp to us, but we will pay to ship your new lamp back to you, once repaired or replaced.

Reminder: We are not responsible for any accidents involving broken glass, so be careful. It can be sharp!

3) Send the lamp to Psyleron within 30 days of the date of purchase. Indicate whether you prefer a repair, replacement, or refund. See below for shipping information.

*1-Year Limited Warranty
After the initial 30-day period, you Mind Lamp is covered by a 1-year limited warranty. Psyleron will repair or replace defective lamps at its discretion. Defective lamps are lamps with electrical or mechanical problems related to its circuitry—this does not include damages to the lamp body. If you request a return or repair, you must pay to ship the lamp to us. Psyleron will pay to ship your new lamp back to you, once repaired or replaced.

Instructions:
1) Contact Psyleron at the address below within 1-year of the purchase date, and let us know why you want a repair or replacement. If we authorize the return, we will provide you with an RMA number.
2) Securely repack your Mind Lamp(s).
3) Insure the package for the full retail price per lamp.
4) Send the lamp to Psyleron within1 year of the purchase date. Include your RMA number inside your shipping box. See below for shipping information.

Instructions:
To return a Mind Lamp, send an email to sales@mind-lamp.com, and tell us why you're returning it. Include your order ID number if you have it. If we authorize the return, we will provide you with shipping details. Note: to receive a repaired or replaced Mind Lamp, you'll need to send back the complete Mind Lamp. You must also insure the package for the full retail price per lamp, in case the lamp breaks in transit. Lamps that arrive broken may not be eligible for repair or replacement.

Product Indemnity Agreement

We don't guarantee the safety of power systems.
By purchasing the Mind Lamp, you agree to hold Psyleron harmless for the behavior of power transformers, coupled transformers, nor the electrical characteristics of foreign or domestic power grids, electrical wiring, or any damages resulting from them, including but not limited to those from fire, smoke, or electrical shock. Psyleron expects the Mind Lamp to be safe with its low internal power levels, but does not guarantee the safety of other power equipment. By purchasing the Mind Lamp, the lamp and any associated electrical equipment are used at your own risk.
